Terms of service

Booking Conditions

1. All participants must declare any medical conditions.
2. All payments to be made to Bow Waves.
3. In the interest of the groups safety and enjoyment alternative options may be given.
4. The participant must be confident in the water.
5. Payment is made in advance and is paid to Bow Waves by cash, cheque or electronic funds transfer.
6. Bookings are required to be accompanied with full payment.
7. Course fee must be paid three weeks in advance.
8. The payment is non-refundable once the booking has been confirmed.
9. We provide all the necessary coaching but as with all training courses and exams we cannot guarantee you pass. The decision of your Instructor or Assessor is final.
10. Safety – Students must listen to and follow guidance given by instructors in regard to safety.
11. Misconduct. Students are required to respect and consider other people and to behave in such a way that it does not cause danger or damage.
12. The centre is entitled without prior notice to expel the student immediately for misconduct. No refunds will be made and students are liable for any damage caused.
13. The participant must be 12 years of age or over for powerboating training activities above level 1.
14. Photographs taken on courses may appear in our brochures and marketing materials. If you wish not to be photographed this should be raised with the centre principal in writing. 15. Cruising courses where people are living on board with special dietary requirements should contact the Bow Waves office as soon as it is convenient.
16. Bow Waves reserves the right to terminate your course at any time if your behaviour is unacceptable. In this instance we have no obligation to pay for any return travel costs or refund any monies paid to us. Any equipment borrowed from the school for the duration of the course must be returned at the end of the course.
17. The cost of replacement will be levied in the event of the non-return of equipment.
18. Age Limit for starting courses varies from seven to eighteen please contact the office to confirm that you are old enough to attend the particular course. There is no upper age limit, but it will be the student’s responsibility to satisfy themselves that they are fit and able to join their chosen course.
19. A separate booking form must be completed by, or on behalf of, each person and for each course. If you complete a form on someone else’s behalf please ensure you are able to give us their full postal address and telephone numbers before contacting us, and you must make them aware of these booking conditions.

Cancellation Conditions

1. If you cancel more than three weeks before the start of a course you will lose only your deposit.
2. If you cancel less than three weeks before the start of a course no refunds will be made for any reason. If you, or anyone for whom you have purchased a course, withdraw after the start of that course no refund will be given.
3. In view of the conditions stated, clients are strongly advised to arrange their own insurance to safeguard their fees in the event of withdrawal or cancellation due to changed personal, health, work or family circumstances (see also the section referring to liability).

Cancellation by Bow Waves

Every attempt will be made to ensure that advertised courses actually run. Bow Waves reserves the right to cancel a course at any time if viable numbers are not achieved or there are circumstances beyond our control, or where it believes on reasonable grounds that cancellation is necessary due to dangerous and or unsuitable conditions for the course to run exist. In this event Bow Waves will give you as much notice as possible and clients will be offered one of the following options:

1. Full refund of all fees already paid.
2. An alternative course on the same date/s.
3. The same course on an alternative date/s.

Bow Waves reserves the right to request anyone who does not meet the course criteria to withdraw from that course. At the Centre’s discretion, an alternative may be offered. No refund will be made in these circumstances.

Force Majeure

In the event of non-performance, partial performance or delay resulting wholly or partly from any force majeure or any occurrence or circumstance whatever beyond Bow Waves Sea School’s control including the acts or omissions of third parties, labour difficulties, weather conditions, technical breakdown or accident to any vessel or any part of it, natural disaster or the act of any authority, then Bow Waves Sea School shall use reasonable endeavours to continue or perform the booking but otherwise shall have no liability to the student. The student shall be liable to pay such a part of the price as is applicable to that part of the booking which has been performed (if any), and all expenses connected with it. Anything in excess paid by the student shall be refunded. Bow Waves Sea School’s determination of the applicable part of the price and the connected expenses shall be conclusive in the absence of manifest error.

Complaints

Are best dealt with at the time; therefore in the first instance students should discuss their area of concern with their Instructor, who will endeavour to correct the matter according to the schools operating procedures. Failing a satisfactory outcome, please contact the Bow Waves school principal.

Liability

Bow Waves is covered by public liability insurance in respect of loss, damage or injury resulting only from negligence by Bow Waves, its agents or employees. It is strongly recommended that clients participating in courses at the Centre take out their own insurance to cover them against loss of fees due to their cancellation, loss of personal possessions and against personal accident and injury.

It will be assumed you accept these conditions unless we hear to the contrary.
